Online Store Regulations

 

§ 1

 

 Preliminary Provisions

 

  1. The online store of Anna Kozlowska- Luc, available at the internet address annakozlowskaluc.com, is operated by Anna Kozlowska- Luc.
  2. This regulation is addressed to Consumers and defines the principles and procedure for entering into a Distance Sales Agreement with the Consumer through the Store.

 

§ 2

 

Definitions

 

1. Seller - an artist the name Anna Kozlowska- Luc.
2. Customer - any entity making purchases through the Store.
3. Store - an online store/ private galery, operated by the Seller at the internet address annakozlowskaluc.com.
4. Distance Agreement - an agreement concluded with the Customer within an organized system of concluding distance agreements (within the Store), without the simultaneous physical presence of the parties, using exclusively one or more means of communication at a distance until the moment of concluding the agreement.
5. Regulations - these Store regulations.
6. Order - the Customer's declaration of will made using the Order Form and directly aiming at the conclusion of a Sales Agreement for a Product or Products with the Seller.
7. Account - the customer's account in the Store, containing data provided by the Customer and information about Orders placed by the Customer in the Store.
8. Registration Form - a form available in the Store enabling the creation of an Account.
9. Order Form - an interactive form available in the Store enabling the placement of an Order, in particular by adding Products to the Cart and specifying the terms of the Sales Agreement, including the method of delivery and payment.
10. Cart - a Store software element in which the Products selected for purchase by the Customer are visible, and there is also the possibility of specifying and modifying Order data, especially the quantity of products.
11. Product - a movable item/service available in the Store that is the subject of a Sales Agreement between the Customer and the Seller.
12. Sales Agreement - a sales agreement for a Product concluded or to be concluded between the Customer and the Seller through the online Store. The Sales Agreement also includes - applying to the features of the Product - a service contract and a work contract.

§ 4

 

Technical Requirements

 

To use the Store, including browsing the Store's assortment and placing orders for Products, the following are necessary:

 

  • An end device with access to the Internet and an internet browser.
  • An active email account (email).
  • Enabled support for cookies files.

 

§ 5

 

General Information

 

The Seller, to the fullest extent permitted by law, is not responsible for disruptions, including interruptions in the operation of the Store caused by force majeure, unauthorized actions of third parties, or incompatibility of the online Store with the technical infrastructure of the Customer.

 

Browsing the Store's assortment does not require creating an Account. Placing orders by the Customer for Products available in the Store is possible either after creating an Account in accordance with the provisions of § 6 of the Regulations or by providing necessary personal and address data enabling the fulfillment of the Order without creating an Account.

 

Prices in the Store are given in euros. Customers from Poland can contact me regarding the purchase of  works In Polish zloty.

 

 The final amount to be paid by the Customer consists of the price for the Product and the cost of delivery (including fees for transport, delivery, and postal services), which the Customer is informed about on the Store's pages when placing an Order, also at the time of expressing the will to be bound by the Sales Agreement.

 

If the nature of the subject of the Agreement does not allow, reasonably assessing, for the earlier calculation of the final price, information on how the price will be calculated, as well as fees for transport, delivery, postal services, and other costs, will be provided in the Store in the Product description.

 

§ 6

 

Creating an Account in the Store

To create an account in the store, you must fill out the registration form. The following information is required: first name, last name, email.

Creating an account in the store is free.

Logging into the account is done by providing the login and password established in the registration form.

The customer has the option to delete the account at any time without stating a reason and without incurring any charges by sending a relevant request to the seller, especially via email or in writing to the addresses provided in § 3.

 

§ 7

 

Ordering Rules

 

To place an order, you must:

 

  1. Log in to the store.
  2. Choose the product to be ordered and then click the "Add to Cart" button.
  3. Log in or use the option to place an order without registration.
  4. If the option to place an order without registration is chosen, fill out the order form by entering the recipient's information and the delivery address for the product, select the type of shipment, enter invoice details if different from the recipient's information.
  5. Click the "Order and Pay" button/Click the "Order and Pay" button and confirm the order by clicking the link sent in the email.
  6. Choose one of the available payment methods and, depending on the payment method, pay the order within the specified period, subject to § 8, point 3.

 

§ 8

 

Offered Delivery and Payment Methods

 

The customer can use the following delivery methods for the ordered product:

  •  Postal shipment
  • Courier shipment

 

The customer can use the following payment methods:

 Payment by bank transfer to the seller's account

  • Electronic payments,
  • Payment by credit card.

 

Detailed information on delivery methods and accepted payment methods can be found on the store's pages.

 

§ 9

 

Execution of Sales Agreement

 

  1. The conclusion of the Sales Agreement between the Customer and the Seller occurs after the Customer submits an Order using the Order Form in the online Store in accordance with § 7 of the Regulations.
  2. After placing the Order, the Seller promptly confirms its receipt and simultaneously accepts the Order for execution. Confirmation of the Order's receipt and its acceptance for execution is carried out by the Seller sending the Customer a relevant email message to the email address provided by the Customer during the Order placement. This email contains at least statements from the Seller about receiving the Order, its acceptance for execution, and confirmation of the conclusion of the Sales Agreement. Upon receipt of the aforementioned email message by the Customer, the Sales Agreement is concluded between the Customer and the Seller.
  3. In the case of the Customer's choice of payment via bank transfer, electronic payment, or credit/debit card, the Customer is obliged to make the payment within 3 calendar days from the date of concluding the Sales Agreement - otherwise, the order will be canceled.
  4. The Product will be dispatched by the Seller within 2-4 business days (subject to paragraph 5 of this section), in a manner chosen by the Customer during the Order placement.
  5. In the case of ordering Products with different delivery times, as specified in the product description, the delivery time is determined by the longest specified term.
  6. The commencement of the delivery period of the Product to the Customer is calculated as follows: in the case of the Customer's choice of payment via bank transfer, electronic payment, or credit/debit card - from the date of crediting the Seller's bank account.
  7. The delivery of the Product takes place within the territory of Poland, the European Union, USA and more.
  8. The delivery of the Product to the Customer is chargeable unless otherwise specified in the Sales Agreement.
  9. The costs of delivering the Product (including fees for transportation, delivery, and postal services) are indicated to the Customer on the online Store's pages in the "Delivery Costs" tab, as well as during the Order placement, including at the moment when the Customer expresses their willingness to be bound by the Sales Agreement.

     10. Currently, with the opening of this store, shipping on all items purchased on the site is free until shipping costs appear on the sales pages. If you are ordering something here to countries located as far away as New Zeland, Australia, Japan- write to me before, You will need to add a shipping fee, because shipments from Poland are very expensive. Thank you very much for your understanding.

 

 

  §10

 

Right of withdrawal from the agreement

 

  1. The consumer may withdraw from the Sales Agreement within 14 days.
  2. The period for withdrawing specified in paragraph 1 shall begin from the delivery of the Product to the Consumer or to a person indicated by them other than the carrier.
  3. The Consumer may withdraw from the Agreement by submitting a statement of withdrawal to the Seller. To meet the deadline for withdrawal from the Agreement, it is sufficient for the Consumer to send the statement before this deadline expires.
  4. The statement may be sent using traditional electronic means by sending the statement to the Seller's email address or by submitting the statement on the Seller's website - the Seller's contact details have been specified in § 3.
  5. In the event of the Consumer sending the statement electronically, the Seller will immediately send the Consumer a confirmation of receipt of the statement of withdrawal from the Agreement to the email address provided by the Consumer.

 

Consequences of withdrawal from the Agreement:

 

In the event of withdrawal from a distance contract, the Agreement is considered void.

 

In the event of withdrawal from the Agreement, the Seller shall refund the Consumer immediately, no later than within 14 days from the day of receiving the returned item from the Consumer, the payment made by the Consumer for the item.

 

The Seller will make the refund using the same payment methods that the Consumer used in the initial transaction, unless the Consumer explicitly agrees to another solution that does not involve any costs for them.

 

The Consumer should return the Product to the Seller at the address indicated for the shipment of the Product immediately, no later than 14 days from the day on which they informed the Seller about the withdrawal from the Agreement. The deadline will be deemed met if the Consumer returns the Product before the 14-day period expires. The Product must be packaged with particular care to protect it from damage during transport.

 

The Consumer bears the direct costs of returning the Product, including the costs of returning the Product if, due to its nature, the Product could not be returned by regular mail.

 

The Consumer is only responsible for any diminished value of the Product resulting from using it in a way other than necessary to ascertain the nature, characteristics, and functioning of the Product.

 

If, due to the nature of the Product, it cannot be returned by regular mail, information about this, as well as the costs of returning the Product, will be included in the Product description in the Store.

 

The right to withdraw from a distance contract does not apply to the Consumer in relation to the Agreement:

 

-for the supply of goods made to the Consumer's specifications or clearly personalized,

 

-for the provision of services if the Seller has fully performed the service with the explicit consent of the Consumer who has been informed before the provision of the service that upon completion by the Seller, they will lose the right to withdraw from the Agreement,

 

-for contracts where the price or remuneration depends on financial market fluctuations over which the Seller has no control and which may occur before the withdrawal period from the Agreement expires,

 

-for the supply of goods which are, after delivery, by their nature, inseparably mixed with other items.

 

§ 11

 

Complaints and warranty

 

For stores selling new products:

 

  1. The Sales Agreement covers new Products.
  2. The seller is obliged to deliver the goods to the customer free from defects.
  3. In the event of a defect in the goods purchased from the seller, the customer has the right to a complaint based on the provisions regarding warranty in the civil code.
  4. The complaint should be reported in writing or electronically to the addresses provided in this Regulation.
  5. It is recommended to include in the complaint a concise description of the defect, circumstances (including the date) of its occurrence, customer data submitting the complaint, and the customer's request regarding the defect of the goods.
  6. The seller will respond to the complaint request promptly, no later than within 14 days, and if he does not do so within this period, it is considered that the customer's request is justified.
  7. Goods returned as part of the complaint procedure should be sent to the address specified in § 3 of this Regulation.
  8. In the case of a product guarantee, information about it and its content will be included in the product description in the store.

 

 

 § 12

 

Personal data in the Online Store

 

1.  The administrator of personal data of Customers collected through the Online Store is the Seller.

 

2.   Personal data of Customers collected by the administrator through the Online Store are gathered for the purpose of executing the Sales Agreement, and if the Customer gives consent, also for marketing purposes.

 

3.  Recipients of personal data of Customers of the Online Store may be:

 

a. In the case of a Customer who uses postal or courier delivery in the Online Store, the Administrator provides the collected personal data of the Customer to the selected carrier or intermediary handling shipments on behalf of the Administrator.

 

b. In the case of a Customer who uses electronic payments or a payment card in the Online Store, the Administrator provides the collected personal data of the Customer to the selected entity handling these payments in the Online Store.

 

4.  The Customer has the right to access their data content and to correct it.

 

5.  Providing personal data is voluntary, but not providing the personal data specified in the Regulations, necessary to conclude the Sales Agreement, results in the impossibility of concluding the said agreement.

 

§ 13

 

Final provisions

 

1.  Agreements concluded through the Online Store are made in Polish.

 

2.  The Seller reserves the right to make changes to the Regulations for valid reasons, such as changes in legal regulations, changes in payment and delivery methods - to the extent that these changes affect the implementation of the provisions of these Regulations. The Seller will inform the Customer about any changes with at least a 7-day notice.

 

3.  Matters not regulated in these Regulations are subject to the generally applicable provisions of Polish law, in particular: the Civil Code; the Act on the provision of electronic services; the Consumer Rights Act; the Personal Data Protection Act.

 

4.  Matters not regulated in these Regulations are subject to the provisions of the Act on the provision of electronic services of July 18, 2002 (Journal of Laws No. 144, item 1204, as amended), the Consumer Rights Act of May 30, 2014 (Journal of Laws 2014, item 827), the Civil Code of April 23, 1964 (Journal of Laws No. 16, item 93, as amended), and other relevant provisions of Polish law.

 

5.  The Customer has the right to use out-of-court complaint and redress methods. For this purpose, they can submit a complaint through the European ODR platform available at http://ec.europa.eu/consum.

1.  This Privacy Policy defines the rules for processing and protecting personal data provided by Users in connection with the use of purchasing services through the Service.

3.  In order to ensure the security of the data entrusted to us, we have developed internal procedures and recommendations to prevent unauthorized access to data. We control their implementation and constantly check their compliance with relevant legal acts - the Personal Data Protection Act, the Act on the provision of electronic services, as well as various executive acts and community law acts.

 

4.  Personal data is processed based on the user's consent and in cases where legal regulations authorize the administrator to process personal data on the basis of legal provisions or for the purpose of performing an agreement concluded between the parties.

 

5.  The Service performs the function of acquiring information about users and their behavior in the following way:

 

a. Through voluntarily entered information in forms.

 

b. By collecting "cookies" files [see the "cookies" policy].

 

6.  The Service collects information voluntarily provided by the user.

 

7.  Data provided in the form is processed for the purpose resulting from the specific form, e.g., to carry out the process of informational contact service.

 

8.  Personal data left on the website will not be sold or made available to third parties, in accordance with the provisions of the Personal Data Protection Act.

 

9.  The person who has placed their data in the form has the right to access and modify it at any time.

 

10.  We reserve the right to change the privacy policy of the service, which may be influenced by the development of internet technology, possible changes in the law regarding personal data protection, and the development of our website. Any changes will be visible and understandable.

 

11.  The Service may contain links to other websites. These websites operate independently of the Service and are not in any way supervised by Anna Kozlowska- Luc. These sites may have their own privacy policies and terms of use, which we recommend reading.

 

12.  Personal data will be processed based on art. 6 para. 1 lit. b), c), and f) of the Regulation of the European Parliament and of the Council (EU) 2016/679 of April 27, 2016, on the protection of natural persons concerning the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (GDPR).
